Former RJD MP Shahabuddin’s bail challenged in Supreme Court
NEW DELHI: A Siwan man today filed a plea in the Supreme Court, challenging bail given to convict and former RJD MP Shahabuddin, who was released on bail earlier this week by the Patna High Court.
The Siwan native, Chandrakeshwar Prasad, has alleged that three of his sons were murdered by the criminal convict.Chandrakeshwar’s lawyer Prashant Bhushan told the Supreme Court that that the Patna High Court made a mistake releasing Shahabuddin from jail.
Bhushan said that a free and fair trial wouldn’t be possible with the history-sheeter, that is, Shahabuddin, out on bail. “Witnesses won’t depose against Shahabuddin out of fear,” Bhushan told the Supreme Court.
“I didn’t ask for ‘chanda’ (donation) as Shahabuddin is saying, Im asking for government help,” Chandrakeshwar told ANI.
“We will be challenging how bail has been given to a person who is a history sheeter. Facts are being verified about the number of cases, etc., and convictions that have taken place against him,” advocate Rohit Singh from Bhushan’s office told PTI yesterday.
Shahabuddin was granted bail on September 7 in the 2014 murder case of Chandrakeshwar Prasad’s son Rajiv Roshan. He was released from Bhagalpur jail on September 10. The criminal had been in jail for 11 years on several other convictions.
“This has been an established process followed by Nitish Kumar government in the past 11 years that if the state is not satisfied with the bail of somebody, it goes in appeal in higher court,” JD(U) spokesperson Ajay Alok said, adding that “it has been done in the past and would be followed in the present case of Shahabuddin too, said yesterday.
