Chief’s Letter to President Murmu on Electoral Bonds Verdict Sparks SCBA Blasts
The SCBA chief had appealed to President Droupadi Murmu to consider seeking a presidential reference regarding the Supreme Court judgment on the electoral bonds scheme case.
On Tuesday, the executive committee of the Supreme Court Bar Association disassociated itself from a letter authored by SCBA chief Adish C Aggarwala, which sought a presidential reference for the apex court’s judgment on the electoral bonds scheme case. The bar association also criticized the letter’s contents, deeming it as an endeavor to exceed boundaries and diminish the authority of the Supreme Court.
“In his letter to the President, Aggarwala expressed concerns that disclosing the names of corporates that had contributed to various political parties could expose them to potential victimization.”
“There is a potential risk that these corporates may face targeting and harassment from political parties that received lesser contributions from them if their names and the amounts contributed to various parties are disclosed. This would violate the commitment made to them when accepting their voluntary contributions.”
He stated that revealing such sensitive information, especially in retrospect, would have a chilling effect on corporate donations and their involvement in the democratic process.
Although the letter was printed on the letterhead of the All India Bar Association, Aggarwala’s title as President of the SCBA was indicated below his signature.
Hence, it has become necessary for the Executive Committee of the Supreme Court Bar Association to emphasize that its members have not authorized the President to write such a letter, nor do they endorse the views expressed therein, as stated in the resolution signed by SCBA secretary Rohit Pandey.
The Executive Committee of the Supreme Court Bar Association also regards this action, as well as its contents, as an effort to exceed bounds and undermine the authority of the Hon’ble Supreme Court of India, and unequivocally condemns it.
