Land acquisition case may resume in HC
NOIDA: The Allahabad high court is likely to begin hearing the ongoing case related to acquisition of 225 hectares of land in Sallarpur in Sector 107 on a daily basis this week. The high court is expected to send its review judgment order to Supreme Court by November-end.
Fate of over 5,000 homebuyers remains to be uncertain ever since the apex court in 2013 stalled five projects after land acquisition in Sallarpur was challenged by farmers of the village.
The buyers say that they have already paid 70-90% of their flat costs and many have no choice but to pay both EMIs and rent.
The Noida Authority acquired the 225-hectare land in Sector 107 in 2008 and 2009, following which builders bought the land on lease and got necessary approvals before launching the projects in 2010-11.
The farmers challenged the land acquisition in the Allahabad high court in 2011, following which the builders moved the Supreme Court, which on August 5, 2013 ruled in favour of the farmers and cancelled the entire notification of land acquisition.
In 2014, the builders filed a review petition in the Supreme Court. The apex court accepted the petition and sent the case back to Allahabad high court for a review.
“It has been a long time now. We think we have reached the flashpoint in the case and hope to get relief this week,” said Puneet Parashar, a buyer.
“Construction in the housing projects first slowed down and then completely stopped. A speedy disposal of the case is now very crucial,” said Sanjeev Priyadarshi, member, Sector 107 Buyers’ Association.
