One-India STD rate faces legal glitch
NEW DELHI: The Department of Telecommunications (DoT)’s promise of a One-India tariff, seeking to harmonise STD rates into a single nation-wide tariff plan is facing serious legal hurdles.
Over 125 million fixed and mobile users are awaiting details of the One-India plan oblivious to the fact that DoT is not empowered to make this announcement.
According to legal experts, Trai Act of 1997 prohibits government, including DoT, from announcing tariff plans in telecom sector. The authority to determine tariffs rests solely with Trai.
Section 11(2) of the Trai Act states that “notwithstanding anything in the Indian Telegraph Act, Trai, from time to time, by Order, may notify the rates at which telecom services within India shall be provided”.
